Terms and Conditions of Sale

§ 1 General Provisions

  1. These Terms and Conditions (hereinafter referred to as the "Terms") define the conditions for the provision of goods sales services by Mariana Bocharova, headquartered in Lublin, at Hugo Kołłątaja Street 3/15, 20-006, conducting business under the name MBocharova, NIP: 8992998039, REGON: 529104394 (hereinafter referred to as the "Service Provider").
  2. The Service Provider, via the website https://mbocharova.com/ (hereinafter referred to as the "Service"), provides services for the sale of clothing, lingerie, footwear, other textile products, and accessories (hereinafter referred to as "Goods").
  3. A Customer, within the meaning of these Terms, is a natural person who uses or intends to use the services of the Service (hereinafter referred to as the "Customer").

§ 2 General Conditions for Service Provision

  1. The Service serves as a tool for the sales process:
    • Enabling the placement of orders and the conclusion of distance sales agreements under the terms specified in these Terms.
    • Allowing the browsing of content posted on the Service.
    • Presenting Customers with marketing content tailored to their interests.
    • Sending newsletters.
  2. Using the Service is permitted only under the rules set forth in these Terms and other documents available on the website https://mbocharova.com/ .
  3. To properly use the Service, the Customer should have a computer or device with software installed that enables browsing the Internet and access to the Internet.
  4. Browsing the Service’s product range does not require an account. Placing orders for Goods available in the Service’s assortment is possible either:
    • After creating an account.
    • By providing the necessary personal and address data to fulfill the order without creating an account.
  5. The Service provides the Customer with the ability to place and pay for orders.
  6. To create an account on the Service, the Customer must complete the registration form, providing the following mandatory information:
    • First name.
    • Last name.
    • Email address.
  7. Creating an account on the Service is free of charge.
  8. Logging into the account is done by entering the email address and password established in the registration form.
  9. The Customer should keep the password assigned during registration confidential and not share it with third parties.
  10. The Customer can delete their account at any time, without providing a reason and without incurring any charges.
  11. Before placing an order for Goods, the Customer is required to read and accept the Terms.
  12. After placing an order for Goods, the Customer will receive an email confirmation of the order along with login details.
  13. For proper service delivery, including maintaining communication with the Customer, the Service Provider will send short technical and/or organizational messages related to the placed orders to the Customer's provided email address and phone number.
    • Such messages do not constitute commercial information within the meaning of the Act of July 18, 2002, on the provision of electronic services.
  14. The Customer is obligated to use the Service in a manner that does not cause inconvenience to other users and to refrain from any actions that may hinder or disrupt the functioning of the Service.
  15. The Customer may use the Service 24/7, regardless of whether they purchase any Goods.

§ 3. Purchase of Goods

  1. Goods can be purchased through the Service. The Customer can purchase the following Goods:
    • Clothing,
    • Lingerie,
    • Footwear,
    • Other textile products
    • Accessories.
  2. To place an order, the Customer must select the Goods they wish to purchase and click the "Add to Cart" button. They may then either log in or use the option to place an order without registration. The order is considered placed upon its payment via the Service.
  3. When placing an order, the Customer provides the following personal data:
    1. First name;
    2. Last name;
    3. Email;
    4. Phone number;
    5. Address;
    6. Postal code;
    7. City;
  4. After placing an order via the Service, the Customer will receive an email confirmation of payment at the provided email address.
  5. By purchasing Goods from the Service Provider via the Service, the Customer simultaneously consents to email communication from the Service Provider for order fulfillment purposes.
  6. Goods delivery is available within the territory of the Republic of Poland and other European Union countries.
  7. The delivery of Goods to the Customer is paid unless otherwise specified in the Sales Agreement. Currently available delivery methods and costs are displayed to the Customer under the "Delivery and Payment" section.
  8. The Seller provides the following delivery options:
    1. InPost courier shipment.
    2. InPost cash-on-delivery courier shipment.
    3. InPost parcel lockers.

§ 4. Payment for Orders

  1. The Customer can purchase Goods at the price listed in the price list. The price is visible before confirming the purchase, after selecting the Goods.
  2. Prices on the Service are displayed in Polish złotys (PLN) and include VAT.
  3. The Customer confirms the purchase of Goods via the Service by clicking the "Place Order" button. After clicking, the Customer will be redirected to the payment page.
  4. Payments for Goods are made in advance by the Customer through the payment platform integrated with the Service, PayPro S.A. (Przelewy24).

§ 5. Order Requirements

  1. A condition for placing an order is its payment via the Service. The Customer cannot order Goods offered by the Service Provider on the Service website without simultaneously paying for them.
  2. The Service Provider reserves that payment is a prerequisite for the Customer's purchase of Goods.

§ 6. Order Cancellation

  1. A Customer who has entered into a distance contract may withdraw from it within 14 calendar days without giving any reason and without incurring costs, except for the costs of returning the Goods (Consumer Rights Act of May 30, 2014). The return address will be provided in response to a submitted complaint.
  2. To exercise the right of withdrawal, the Customer must notify MBocharova via email at hello@mbocharova.com of their decision to withdraw from the contract with an unequivocal statement (e.g., by email).
  3. The Customer may also fill out and send a withdrawal form or any other unequivocal statement via email. After exercising the right of withdrawal, the Customer will receive confirmation of the withdrawal notice via email.
  4. The 14-day withdrawal period is counted from the day the Goods were delivered.
  5. The Goods being returned must be appropriately packaged to prevent damage during transport.
  6. The Customer bears the cost of packaging and returning the Goods.
  7. In the event of withdrawal, the Customer is refunded the payment for the Goods no later than 14 days from the withdrawal date.
  8. Refunds are made using the same payment methods as the original transaction unless agreed otherwise.
  9. MBocharova may withhold the refund until the Goods are received or proof of their return is provided, whichever occurs first

§ 7. Liability

  1. The Service Provider is not responsible for damages resulting from improper use of the Service by the Customer or consequences arising from third-party access to Customer order details if caused by the Customer's negligence.
  2. The Customer is obligated to provide truthful data and statements when placing an order. The Service Provider is not liable for consequences resulting from false information or statements provided by the Customer.
  3. The Service Provider commits to providing services at the highest possible standard. In the event of technical issues beyond the Service Provider's control that could affect order delivery times, the Service Provider reserves the right to ensure order fulfillment promptly.

§ 8. Goods Complaints

  1. If sales services are provided in a manner inconsistent with these Terms or applicable Polish law, the Customer has the right to file a complaint.
  2. Complaints can be submitted electronically via the address: https://mbocharova.com/ .
  3. Complaints should include a detailed description of the issue and the Customer’s contact information to allow MBocharova to respond.
  4. The Service Provider may request additional information necessary to respond to the complaint.
  5. The Service Provider will respond to the complaint within 14 days of receiving complete information.
  6. It is recommended to check the parcel's contents in the courier's presence upon delivery and prepare a complaint protocol. This service is free of charge and part of the courier's responsibilities.
  7. If the delivered parcel is visibly damaged (e.g., wet, significantly dented, torn packaging), it is recommended to refuse acceptance. The parcel will be immediately returned to the Service Provider for investigation and redelivery of the ordered Goods.
  8. The legal basis and scope of the Service Provider's liability towards the Customer, if the sold Goods have a physical or legal defect (warranty), are defined by the Civil Code, particularly Articles 556 and subsequent.
